1. ELIGIBILITY:  To be eligible to win in the #FUNWAREHOUSE Challenge contest, the person who posts must be 18 years or older and have signed the Fun Warehouse waiver. If you have not filled out the waiver, you can find it here. Employees of Fun Warehouse, and immediate family members and/or those living in the same household as Employees are not eligible to participate. The contest is subject to applicable federal, state, and local laws and regulations. Void where prohibited. If Your Challenge post is chosen and shared on the Fun Warehouse Facebook page, you agree to neither remove the chosen challenge post or alter the post in any way for the term of 1 year after being chosen and shared. If these terms are not followed, Fun Warehouse reserves the right, in its sole discretion, to revoke Your Winner status and void your prize.
   
   
2. AGREEMENT TO RULES: By posting and using the hashtag #FUNWAREHOUSE, the Contestant (“You”) agrees to be fully and unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Fun Warehouse as final and binding as it relates to the content of the contest.
   
   
3. CONTEST PERIOD: Entries will be accepted online starting on 7/1/2023 and will be ongoing with an ending TBD.
   
   
4. HOW TO ENTER: The #FUNWAREHOUSE Challenge Contest can only be entered by both: sharing your Fun Warehouse photos, videos and/or reels on to Your personal Facebook Page and using the hashtag #FUNWAREHOUSE as well as leaving a Google Review on the Fun Warehouse Google Review page that can be found here. The “entry” must fulfill all contest requirements, as specified, to be eligible to win the prize. Only one “entry” can be chosen per person per personal Facebook page. You may not enter more times than indicated by using multiple email address, identities, or devices in an attempt to circumvent the rules. If You use fraudulent methods or otherwise attempt to circumvent the rules, your “entry” may be removed from eligibility at the sole discretion of Fun Warehouse.
   
   
5. PRIZE: The Winner(s) of the #FUNWAREHOUSE Challenge Contest who have completed all requirements and whose Challenge Post has been chosen and shared on the Fun Warehouse Facebook page will receive 2 FREE ACTIVITY PASSES with a combined value of $24. Actual value may differ at time of the prize award. No cash or other prize substitution shall be permitted. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner(s). No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Fun Warehouse to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law.
   
   
6. WINNER SELECTION AND NOTIFICATION: Winner(s) will be selected by Fun Warehouse or by an outside entity selected by Fun Warehouse. Winner(s) will be attempted to be notified via Direct Message from the Fun Warehouse Facebook page. Winner(s) will also be notified via Facebook notifications of the “Share” by Fun Warehouse, or by checking the Fun Warehouse Facebook page. If You do not receive the direct message notification from the Fun Warehouse Facebook page, but You receive the notification or see that Your challenge post has been shared, You must contact Fun Warehouse via Facebook Direct Message to set up a time in which You can either pick up your 2 FREE ACTIVITY PASSES or come in to Fun Warehouse to redeem your passes. Fun Warehouse shall have no liability if the Winner(s) fail to receive any notifications via direct message or otherwise. Winner(s) have up to 1 year to claim and redeem their prize.

RIGHTS GRANTED BY YOU: By sharing this content (photos, videos or reels) and entering the Challenge Contest by using the hashtag #FUNWAREHOUSE, You understand and agree that Fun Warehouse, anyone acting on behalf of Fun Warehouse, and Fun Warehouse’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now know or hereafter developed, in perpetuity and throughout the world, without limitation, your “entry”, name, portrait, picture, voice, likeness, image, statements about the Contest and or reviews, and biographical information for news, publicity, information, advertising, public relations, and promotional purposes, without any further compensation, notice, review or consent. By entering this content, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Fun Warehouse. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Fun Warehouse from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Fun Warehouse may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
   
   
8. TERMS & CONDITIONS: Fun Warehouse reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond Fun Warehouse’s control corrupt or affect the administration, security, fairness, or proper conduct of the contest. In such case, Fun Warehouse may select the Winner(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by Fun Warehouse. Fun Warehouse reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the “entry” process or the operation of the contest if it violates these Terms & Conditions.

LIMITATION OF LIABILITY: By posting and using the hashtag #FUNWAREHOUSE for your “entry”, You agree to release and hold harmless Fun Warehouse and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such participation in the contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the “entry” process or the contest; (v) electronic or human error in the administration of the contest or the processing of entries.
   
   
10. DISPUTES: This contest is governed by the laws of the United States and South Carolina, without respect to conflict of law doctrines. As a condition of participating in this contest, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Horry County having jurisdiction. Further, any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this contest). Participant further wavies all rights to have damages multiplied or increased.
